1. Agreement to Terms

These Terms of Service ("Terms") govern your use of MacFlow Setup's website, services, and all related content, features, and functionality (collectively, the "Services"). By accessing, browsing, or using our Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use our Services.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Services after such modifications constitutes acceptance of the updated Terms.

2. Use License

Subject to your compliance with these Terms, MacFlow Setup grants you a non-exclusive, non-transferable, revocable license to use our Services for lawful purposes. You agree not to:

  • Use the Services for any illegal, fraudulent, or unauthorized purpose
  • Reproduce, distribute, transmit, modify, or create derivative works of our content or services
  • Attempt to gain unauthorized access to our systems or networks
  • Reverse engineer, decompile, or disassemble any part of our Services
  • Harass, threaten, defame, or abuse other users
  • Transmit viruses, malware, or any harmful code
  • Spam, flood, or interfere with our Services
  • Scrape, crawl, or use automated tools without authorization

3. Service Description

MacFlow Setup provides personalized Mac configuration services designed to optimize your macOS experience. Our Services include:

  • Initial consultation to assess your workflow and needs
  • System preference customization and keyboard shortcut mapping
  • Automation workflow creation using macOS Shortcuts
  • Live setup sessions via video call
  • Post-setup support (duration varies by package)

Service scope and deliverables are defined in your specific service package agreement. Setup is customized based on your provided workflow information and preferences. Results may vary based on your Mac model, macOS version, and existing software configuration.

4. Booking, Scheduling & Cancellation

  • Booking: To book a service, you must provide accurate contact information and complete payment. A setup session will be scheduled at a mutually agreed time.
  • Confirmation: Setup confirmation will be sent via email. Please verify the date and time and respond to confirm your availability.
  • Cancellation by Client: Cancellations made 7+ days before your session receive a full refund. Cancellations 3–6 days before incur a 50% service charge. Cancellations within 48 hours or no-shows forfeit full payment.
  • Rescheduling: You may reschedule once without penalty if requested 7+ days in advance. Additional reschedules may incur fees.
  • Cancellation by MacFlow: We may cancel for operational reasons with 7+ days' notice and offer full refund or rescheduling.

5. Payment Terms

Payment terms are as follows:

  • Payment Due: Full payment is due at the time of booking unless alternative arrangements are made
  • Payment Methods: We accept credit cards, debit cards, and other payment methods processed securely through third-party payment processors
  • Taxes: You are responsible for any applicable sales tax, VAT, or other taxes on our Services
  • Refunds: Refunds are issued according to our cancellation policy (Section 4). Refunds are processed within 5–10 business days
  • Late Payment: Overdue payments may result in suspension of services and late fees
  • Price Changes: We reserve the right to adjust pricing with 30 days' notice. Existing bookings are honored at the originally quoted price

6. Service Availability & Limitations

While we strive to provide reliable Services, we do not guarantee:

  • Uninterrupted access to our Services or website
  • Specific results or outcomes from Mac customization (results vary by individual use case and technical environment)
  • Compatibility with all macOS versions, Mac models, or third-party software
  • That customizations will persist through macOS updates (we document all changes and provide guidance)
  • Resolution of pre-existing technical issues unrelated to our customization scope

MacFlow Setup is not responsible for data loss, system conflicts, or software incompatibilities. You should back up your Mac before any setup session.

7. Intellectual Property Rights

All content on our website and in our Services—including text, graphics, logos, images, software, and documentation—is the property of MacFlow Setup or our licensors and is protected by copyright, trademark, and other intellectual property laws.

  • You may not reproduce, distribute, or transmit any content without our written permission
  • Custom Shortcuts and automation workflows created during your setup are yours to use and modify
  • We may reference your setup (with permission) as a case study or testimonial
  • macOS, Finder, and other Apple products are trademarks of Apple Inc.

8. User Accounts & Security

If you create an account with MacFlow Setup:

  • You are responsible for maintaining the confidentiality of your login credentials
  • You agree to provide accurate and complete information
  • You are responsible for all activity under your account
  • You must notify us immediately of any unauthorized access or security breach
  • We are not liable for unauthorized access to your account due to your negligence

9. Limitation of Liability

To the fullest extent permitted by law, MacFlow Setup shall not be liable for:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of data, revenue, profits, or business opportunities
  • Interruption of service or unavailability of the website
  • Errors, omissions, or inaccuracies in content or Services
  • Third-party actions or failures

Our total liability for any claim arising from these Terms or use of our Services shall not exceed the amount you paid for the specific service in question. Some jurisdictions do not allow limitation of liability, so this provision may not apply to you.

10. Disclaimer of Warranties

MacFlow Setup Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We disclaim all warranties including:

  • Merchantability, fitness for a particular purpose, or non-infringement
  • That Services will meet your requirements or expectations
  • That Services will be error-free, secure, or uninterrupted

We make no warranty regarding the results or outcomes of our Services. Success depends on your individual workflow, technical environment, and adherence to recommendations.

11. Indemnification

You agree to indemnify, defend, and hold harmless MacFlow Setup, its officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of our Services or website
  • Your breach of these Terms
  • Your violation of applicable laws or third-party rights
  • Your unauthorized access to your Mac or account information

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the District of Columbia, without regard to its conflict of law principles.

  • Informal Resolution: Before initiating formal proceedings, you agree to attempt resolution by contacting us at setup@macflow.local
  • Mediation: If informal resolution fails, disputes will be subject to non-binding mediation
  • Jurisdiction: You consent to the exclusive jurisdiction of the courts located in the District of Columbia for any legal proceedings
  • Waiver of Jury Trial: You waive any right to jury trial in disputes

13. Termination

MacFlow Setup may terminate your access to Services at any time, with or without cause, by providing notice. Grounds for termination include violation of these Terms, non-payment, or misuse of Services.

Upon termination, your right to use Services ceases immediately. Outstanding payment obligations remain due. Sections on Limitation of Liability, Indemnification, and Governing Law shall survive termination.
